DIY Credit Restoration Service Agreement

Version 4.0

Concord USA LLC ("we", "us", "the Company") is keen on helping you with whatever problem you might have with your credit. This Agreement is a self-service ("DIY") software subscription. You alone decide which items to dispute, you alone sign each dispute letter, and you alone mail each letter to the credit bureaus and furnishers. Concord USA LLC is not acting on your behalf as a credit repair organization.

1. Documents You Must Sign

Before using the platform you must review and sign the following:

  • This DIY Credit Restoration Service Agreement
  • SEC.405 Disclosure of Consumer Credit File Rights
  • Privacy Policy
  • Limited Authorization & Acknowledgment

2. Credit Reports

Service begins immediately after all documents are signed and you connect your SmartCredit account. The platform will pull your three-bureau credit report and keep it refreshed on a recurring cadence (approximately every 45 days) so you can track dispute progress.

3. Details of Services

The DIY subscription gives you tools to:

  1. Prepare dispute rounds for the three credit bureaus.
  2. Prepare dispute rounds for creditors, if needed.
  3. Prepare dispute rounds for collection agencies, if needed.
  4. Review updated credit reports pulled from your SmartCredit account.
  5. Review documents you upload (ID, proof of address, supporting evidence).
  6. Receive educational email content on the credit-score improvement process.
  7. Receive educational email content on the dispute process.
  8. Track your dispute progress in your client portal.

4. Fees & Billing

The subscription fee is $50.00 per month, billed automatically each month through our payment processor. Your card is charged on the date you sign this Agreement and on the same day each month thereafter until you cancel.

5. Duration of Service

The subscription is month-to-month and begins on the date you sign this Agreement. There is no minimum term.

6. Refunds

In the world of credit repair, the outcome of a service cannot be guaranteed, and no company can promise a result. We put in our best effort to help you identify and dispute incorrect, incomplete, or inaccurate information on your credit reports. Except for the statutory three (3) business day right of cancellation described in Section 14 and in the SEC.405 Disclosure, subscription fees are non-refundable. Cancelling stops future billing but does not refund prior monthly charges.

7. Cancellation

You can cancel your subscription at any time from the Billing page in your portal. Cancellation takes effect at the end of the current billing period; you retain access to the platform through the end of that period.

7a. No Chargebacks

You agree not to initiate, request, or authorize any chargeback, payment reversal, or dispute with your card issuer, bank, or payment processor for any subscription fee or other charge paid to Concord USA LLC. If you believe a charge is incorrect, you must first contact us at info@fixmyreports.com and give us a reasonable opportunity to resolve the issue. Cancellation is always available from the Billing page and is the correct way to stop future charges.

If you file a chargeback in violation of this Section, you agree that Concord USA LLC may:

  • Suspend or terminate your account immediately;
  • Pursue any and all legal remedies available, including filing suit, retaining collection agencies, and reporting the unpaid amount to credit bureaus; and
  • Recover the disputed amount plus all costs and expenses incurred in responding to and collecting on the chargeback, including (without limitation) processor chargeback fees, bank fees, collection costs, court costs, and reasonable attorney's fees.

You agree that all such costs and expenses are your sole responsibility and are recoverable as liquidated damages. This Section survives termination of this Agreement.

8. Your Responsibilities

  • Provide accurate personal information (name, address, SSN, date of birth).
  • Upload a government-issued ID and a current proof of address.
  • Personally sign every dispute letter generated by the platform before mailing.
  • Mail letters via USPS Certified Mail with Return Receipt at your own expense; retain the tracking receipt.
  • Keep your account credentials confidential.
  • Provide correspondence (uploaded letters and bureau responses) in a timely manner; delays in your responses delay your progress.
  • Notify Concord USA LLC of any change in your mailing address.

9. No Guarantee of Results

Concord USA LLC makes no warranty, express or implied, that any specific item will be deleted, updated, or modified on your credit report, or that your credit score will change by any specific amount. By law, Concord USA LLC cannot be held accountable for the outcome of any dispute or the time taken to achieve a desired outcome.

10. Indemnification

You shall defend, indemnify, and hold harmless Concord USA LLC, its officers, employees, and agents, from and against all costs, charges, and expenses (including reasonable attorney's fees) arising out of your use of the platform, your submissions to credit bureaus or furnishers, or any negligence on your part.

11. Limitation of Liability

To the maximum extent permitted by law, Concord USA LLC's aggregate liability under this Agreement is limited to the fees you paid in the twelve (12) months preceding the claim. Concord USA LLC is not liable for lost profits, lost savings, or any indirect, incidental, consequential, or punitive damages stemming from your use of the platform or any breach of this Agreement.

12. Termination

Either party may terminate this Agreement at any time. Termination by you takes effect at the end of the current billing period. Concord USA LLC may terminate for fraud, abuse, non-payment, or violation of this Agreement.

13. Arbitration

Any dispute arising from this Agreement shall be settled by binding arbitration in accordance with the United States Arbitration and Mediation Rules of Arbitration. Upon completion of arbitration, all decisions shall be final and binding, and judgments may be entered for enforcement in any court of competent jurisdiction.

14. Right to Cancel

You may cancel this Agreement within five (5) business days of signing it without incurring any penalty. Any payment made by you will be returned within fifteen (15) days of receiving your cancellation notice. 15. Digital Signature

You agree that typing your full legal name into the signing form constitutes your legal electronic signature under the ESIGN Act and UETA. You may withdraw your digital signature (and cancel this Agreement) at any time by emailing info@fixmyreports.com.

16. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles.

17. Entire Agreement

This Agreement, together with the SEC.405 Disclosure, Privacy Policy, and Limited Authorization & Acknowledgment, constitutes the entire agreement between you and Concord USA LLC and supersedes all prior communications or agreements between the parties regarding the subject matter.

IN WITNESS WHEREOF, by signing electronically below, the parties have executed this Agreement as of the date of signature.

SEC.405 Disclosure of Consumer Credit File Rights Under State and Federal Law

You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any "credit repair" company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over seven (7) years old. Bankruptcy information can be reported for ten (10) years.

You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, or insurance. You can receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.

You have a right to sue a credit repair organization that violates the Credit Repair Organizations Act. This law prohibits deceptive practices by credit repair organizations.

You have the right to cancel your contract with any credit repair organization for any reason within three (3) business days from the date you signed it.

Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur. You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then investigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.

If the credit bureau's investigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.

Privacy Policy (v2.0)

Our policy on privacy is straightforward. Any information you submit to Concord USA LLC will remain private and will not be sold or shared with third-party marketers.

Categories of Information We Collect

Personally identifiable information we collect from you includes: your name, postal address, telephone number, email address, date of birth, Social Security number, government-issued ID and proof-of-address documents that you upload, and your SmartCredit login credentials (stored in encrypted form). When you authorize a credit-report pull, we also receive your three-bureau credit report data from SmartCredit.

Non-personally identifiable information we collect includes device, browser, and usage data necessary to operate and secure the platform.

How We Use Your Information

  • To prepare dispute letters and other documents on your behalf.
  • To pull and display your credit reports inside your client portal.
  • To track the status of your disputes and notify you of changes.
  • To bill your subscription and respond to support requests.
  • To comply with applicable law.

How We Disclose Your Information

We disclose personally identifiable information only:

  • To the credit bureaus and furnishers named on the dispute letters that you sign and mail.
  • To our payment processor (Square) for the limited purpose of processing your subscription payments.
  • To SmartCredit for the limited purpose of authenticating and pulling your credit report.
  • To comply with a subpoena, court order, or applicable law, or in cooperation with a lawful law-enforcement or government request.

We do not sell your personally identifiable information and we do not share it with marketers or retailers for their own offers.

How We Store and Protect Your Information

  • SmartCredit credentials are encrypted at rest using authenticated encryption.
  • Your records are isolated per-user with row-level security in our database.
  • Uploaded documents are stored in a private bucket accessible only to your account.
  • Access by staff is restricted to verified administrators with role-based permissions.

How We Collect Information

We collect personally identifiable information from you by activemeans — you actively provide it through sign-up, onboarding, and document uploads. We do not buy personal data from third parties.

Your Rights

You may request an export or deletion of your personal data at any time by emailing info@fixmyreports.com. We will respond within thirty (30) days. Deletion does not affect records we are required to retain by law (e.g. billing records).

Your Acceptance of This Policy

By signing the agreements presented during onboarding, you acknowledge this Privacy Policy. If you do not agree, do not sign the agreements and do not use the platform.
